Consumer Health Data Privacy Policy

This policy explains how Birth Wave LLC (“BirthWave”) collects, uses and shares consumer health data, and how you can exercise your rights over it. It is provided under the Washington My Health My Data Act and applies to consumers in Washington, Nevada and Connecticut. All other personal information is described in our general Privacy Policy.
Section 1Categories of consumer health data we collect, and why
BirthWave is a music and audio app for pregnancy, labour and early motherhood. The following data may identify your past, present or future physical or mental health status, or allow that status to be inferred.
- Reproductive and pregnancy status
- Profile information you choose to give us, including first name, mom date of birth, baby due date, and any stage or journey information you choose to add. Collected so the app can show content relevant to where you are in your pregnancy or postpartum period.
- Health-related inferences from use
- The fact that you hold a BirthWave account, and the categories and tracks you play, browse and save — including labour, hypno, affirmations and postpartum content. Collected to deliver playback, remember your favourites, and understand in aggregate which content is used so we can improve the library. Because of what the app is for, this can imply that you are pregnant, preparing for birth, or recovering from one.
- Health-related messages you send us
- Anything about your pregnancy, birth or health that you choose to include when you email our support address. Collected only to answer you.
We do not collect precise location data, and we do not use consumer health data for advertising, profiling or any purpose other than those stated above.
Section 2Categories of sources
- Directly from you, through your profile, your account, and messages you send us.
- Automatically from your device as you use the app, through the analytics and infrastructure providers listed in Section 4.
- From Apple, Google and our subscription provider, in the form of a confirmation that you hold a BirthWave subscription.
Section 3Categories of consumer health data we share
We share the categories described in Section 1 only to the extent our service providers must process them to operate the app: profile information, listening and favourites activity, account identifiers, and subscription status.
We do not sell consumer health data. We do not disclose it for advertising or for any third party's own purposes. Selling consumer health data would require your separate, signed authorisation, and we do not seek one.
Section 4Third parties and affiliates who receive it
- Google LLC
- Firebase Authentication, Cloud Firestore, Cloud Storage, Firebase Hosting, Google Analytics for Firebase and Firebase Crashlytics — account, profile, favourites, audio delivery, analytics and crash reporting.
- RevenueCat, Inc.
- Subscription status and entitlement management.
- Apple Inc. and Google LLC
- Payment processing and subscription billing.
- Netlify
- Hosting of mybirthwave.com and public legal pages.
- Email service provider
- Delivery of service, support, waitlist or product emails if configured for BirthWave. We will update this policy with the provider name if a dedicated email platform is added.
- Affiliates
- BirthWave has no affiliates. If that changes, this policy will be updated before any sharing occurs.
- Legal disclosures
- Law enforcement or other parties where we are legally compelled, or where necessary to establish, exercise or defend legal claims.
Each provider is contractually restricted to processing consumer health data on our instructions and for the purposes stated in this policy.
Section 5Your rights and how to exercise them
You have the right to:
- Confirm and access — ask whether we collect, share or sell your consumer health data, and receive a copy, together with a list of all third parties with whom we have shared it and contact information for each.
- Withdraw consent — withdraw your consent to our collection and to our sharing of your consumer health data, separately.
- Delete — ask us to delete your consumer health data. We will delete it from our records, including from archived and backup systems, and will notify each service provider and third party that received it.
- Appeal — if we refuse a request, ask us to reconsider.
How to make a request
Email support@mybirthwave.com with the subject line “Consumer health data request”, and tell us which right you are exercising. You can also delete your account and its associated data directly in the app, or through our account deletion page at mybirthwave.com/delete-account.
We will verify your identity by confirming that you control the email address on the account, and will respond within 45 days. We may extend that by a further 45 days where reasonably necessary, and will tell you if we do. There is no charge for the first two requests in a twelve-month period.
How to appeal
If we decline a request, reply to our decision with the subject line “Consumer health data appeal”. We will respond in writing within 45 days explaining the outcome. If we deny the appeal, you may complain to the Washington State Attorney General at atg.wa.gov/file-complaint, or to the attorney general of your own state.
Section 6Changes to this policy
We will not collect, use or share categories of consumer health data, or use it for purposes, not disclosed above without first updating this policy and obtaining your affirmative consent.
