Welcome to BirthWave. These Terms of Service ("Terms") govern your use of the BirthWave mobile application and related services ("Service") operated by BirthWave ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

BirthWave is a premium music application for pregnancy, birth, and early motherhood. Access to the full music library requires an active subscription. We may update, modify, or discontinue features of the Service at any time.

2. Accounts

You must create an account to use BirthWave. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information when completing your profile.

3. Subscriptions & Free Trial

BirthWave offers a 7-day free trial for new subscribers. After the trial period, your subscription renews automatically unless cancelled at least 24 hours before the end of the current period. All payments are processed through Apple App Store or Google Play in-app purchases. Pricing, billing cycles, and cancellation are managed through your device's app store account settings.

4. Restore Purchases

If you reinstall the app or switch devices, you may restore your active subscription using the "Restore Purchases" feature within the app, subject to your app store account history.

5. Acceptable Use

You agree not to copy, redistribute, record, or commercially exploit any content from the BirthWave library. The Service is for personal, non-commercial use only.

6. Intellectual Property

All music, artwork, branding, and software within BirthWave are owned by BirthWave or its licensors and protected by copyright and other intellectual property laws.

7. Account Deletion

You may delete your account at any time through the app settings. Account deletion is permanent and will remove your profile data. Deleting your account does not automatically cancel an active subscription — you must cancel through your app store.

8. Disclaimer

BirthWave provides music for wellness and emotional support. It is not medical advice and does not replace care from a qualified healthcare provider. Always consult your doctor or midwife regarding pregnancy, labor, and postpartum health decisions.

9. Limitation of Liability

To the fullest extent permitted by law, BirthWave shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

  • Provide and maintain the BirthWave music library and playback features
  • Manage your account, profile, and subscription access

3. In-App Subscriptions

Subscriptions and free trials are processed entirely through Apple or Google. We receive confirmation of your subscription status but do not have access to your full payment information. Please review Apple's and Google's privacy policies for details on how they handle payment data.

4. Data Sharing

We do not sell your personal information. We may share data with trusted service providers who help us operate the App (such as hosting and analytics), subject to confidentiality agreements. We may also disclose information if required by law.

5. Data Retention

We retain your account data for as long as your account is active. When you delete your account through the app, we will delete or anonymize your personal data within a reasonable timeframe, except where retention is required by law.

6. Your Rights

Depending on your location, you may have the right to access, correct, or delete your personal data. You can update your profile or delete your account directly within the App. For additional requests, contact us at the email below.

7. Children's Privacy

BirthWave is intended for adults. We do not knowingly collect personal information from children under 13. If you believe a child has provided us data, please contact us so we can remove it.

We implement reasonable technical and organizational measures to protect your information. However, no method of transmission over the internet is 100% secure.
